Terms of Service

These Terms set out the conditions for using WatchScribe (the "Software") provided by VIT Works (the "Provider"). By installing or using the Software, or by purchasing a paid plan, you are deemed to have agreed to these Terms and to the Privacy Policy.
Article 1 (Definitions)
- Free: The scope of the Software available at no charge. It includes automatic activity tracking, dashboard visualisation, the timeline, category classification, exclusion rules, manual notes, data export, and manual daily report generation.
- Pro: The paid scope. It includes scheduled automatic generation of daily reports and report generation enriched by vision analysis.
- Pro Subscription: A plan that provides Pro on a monthly billing basis.
- Pro Lifetime: A plan that provides Pro through a one-time purchase.
- Device: One computer on which the Software is installed.
- Account: The contract unit identified by the user's email address.
- Sign-in: The operation of entering the verification code sent to the email address, thereby associating that device with the Account.
Article 2 (Plans and Pricing)
1. The Software is offered under three plans: Free, Pro Subscription ($1 per month), and Pro Lifetime ($10 one-time).
2. Prices are those displayed at the time of purchase. The Provider may change future prices; changes do not apply retroactively to contracts already concluded.
3. Free may be used without a time limit and requires no registration or sign-in.
Article 3 (Account and Device)
1. Using Pro requires signing in with an email address. No password is set; authentication is completed by entering a verification code.
2. One Account may use Pro on one Device. If you sign in on another Device, the most recently signed-in Device becomes active, and the previous Device switches to the equivalent of Free at its next entitlement check.
3. When you replace a Device, no prior deregistration is required. Simply sign in with the same email address on the new Device.
4. You are responsible for managing the email address associated with your Account and any verification codes you receive.
5. Signing out from the app deletes the authentication credentials stored on that Device.
Article 4 (Offline Grace Period)
The Software checks your entitlement periodically. For 14 days after the last successful check, you may continue to use Pro even without a network connection. If the entitlement cannot be confirmed beyond that grace period, the Software switches to the equivalent of Free. If the contract period has expired, or a sign-in on another Device is confirmed, the switch occurs immediately regardless of the grace period.
Article 5 (Handling of Data)
Even when the Software switches to the equivalent of Free, data already recorded, reports already generated, and your settings are not deleted. Only the range of available features changes. Details of the data recorded by the Software are set out in the Privacy Policy.
Article 6 (Cancellation)
Cancellation of a Pro Subscription and changes to your payment method are handled in the payment provider's customer portal, which can be opened from the settings screen of the app. Unless otherwise stated, cancellation takes effect from the next renewal date, and Pro remains available until then.
Article 7 (Refunds)
Because this is digital content, refunds are generally not accepted for customer convenience after purchase is confirmed. The policies established by the payment provider may apply.
Article 8 (Prohibited Conduct)
You must not do any of the following when using the Software.
- Attempt to analyse the source code, including reverse engineering, decompiling, or disassembling the Software
- Share, lend, transfer, or sell an Account
- Circumvent or disable entitlement checks or other functions
- Violate laws or public order and morals
- Infringe the intellectual property rights, privacy rights, or other rights and interests of third parties
Article 9 (Disclaimer)
1. The Software is provided AS IS. The Provider does not warrant fitness for a particular purpose, accuracy, completeness, or continued availability.
2. The Provider does not warrant the accuracy of the daily reports, category classifications, or aggregated results the Software produces. You should review the content as necessary.
3. Except in cases of wilful misconduct or gross negligence, the Provider is not liable for damages arising from use of the Software. Even where liability applies, it is limited to the amount of fees you have paid (one month's fee in the case of recurring billing).
4. The Provider is not liable for damages arising from specification changes, suspension, or failure of the payment provider or other third-party services.
Article 10 (Exclusion of Anti-Social Forces)
You represent that you do not belong to any anti-social forces (organised crime groups, their members, or affiliated companies) and warrant that you will not do so in the future.
Article 11 (Changes to These Terms)
The Provider may change these Terms as necessary. Revised Terms take effect when published on the website, and significant changes may be announced in the app or on the website.
Article 12 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute concerning the Software shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Provider's head office as the court of first instance.
